By accessing or using the Try It Program website, platform, or any related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms") and all applicable laws and regulations. If you do not agree with any part of these Terms, you must not use our Service.

Our role is strictly limited to:

• Transmitting your contact information and other provided data to affiliate partners at your direction
• Facilitating the connection between you and Third-Party Offer operators

To use the Service, you must:

• Be a legal resident of the United States or another jurisdiction where the Service is lawfully available
• Provide accurate, current, and complete information when requested
• Not be prohibited from receiving services under applicable law or regulation

Try It Program is compensated by its affiliate partners and advertisers when users are referred to their platforms and/or complete specified actions such as registrations or sign-ups. This compensation may influence which offers are presented to you and how they are displayed.

By submitting your information through our Service, you expressly consent to:

• Your contact information (including name, email, phone number, and other submitted details) being shared with one or more affiliate partners
• Affiliate partners contacting you via email, telephone, and SMS/text message using the information you provide
• Our affiliate partners operating independently and being solely responsible for their communications and offers

When you click on a Third-Party Offer or are redirected to an affiliate website, you leave the Try It Program platform and are subject to the terms, conditions, and privacy policies of that third-party operator. Try It Program has no control over, and assumes no responsibility for, the content, products, services, or practices of any third-party websites or operators.

You acknowledge and agree that:

• Try It Program does not review, endorse, or guarantee the accuracy or legality of any Third-Party Offer
• Sweepstakes and promotional programs have their own eligibility requirements, entry methods, odds, and prize fulfillment processes governed entirely by the sponsoring company
• Any purchase requirement, subscription, or financial commitment associated with a Third-Party Offer is solely between you and that third party
• Any disputes related to a Third-Party Offer must be resolved directly with that third party

Try It Program collects personal information you voluntarily provide when using our Service. Our collection and use of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

You expressly acknowledge and agree that:

• Information you submit may be transmitted to and stored by third-party affiliate partners who maintain their own independent privacy policies and data practices
• Try It Program is not responsible for how third-party affiliates collect, store, use, or disclose your personal information once it has been shared with them at your direction
• Third-party affiliates may retain your information independently of Try It Program, governed solely by their own privacy policies
• You should review each third party's privacy policy before submitting information to or through their platforms

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, TRY IT PROGRAM DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• Implied warranties of merchantability, fitness for a particular purpose, or non-infringement
• Warranties that the Service will be uninterrupted, timely, secure, or error-free
• Warranties regarding the accuracy, reliability, or completeness of any content
• Warranties regarding results that may be obtained from participation in any Third-Party Offer
• Warranties regarding third-party websites, products, or services accessible through our platform

No advice or information, whether oral or written, obtained from Try It Program shall create any warranty not expressly stated in these Terms.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TRY IT PROGRAM, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, revenue, data, goodwill, or other intangible losses
• Damages arising from your participation in, or inability to participate in, any Third-Party Offer or sweepstakes program
• Damages arising from the acts or omissions of any third-party affiliate, advertiser, or sweepstakes operator
• Unauthorized access to or alteration of your transmissions or data by third parties

You agree to defend, indemnify, and hold harmless Try It Program and its officers, directors, employees, contractors, agents, licensors, service providers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

• Your violation of these Terms
• Any information you submit through the Service
• Your participation in any Third-Party Offer or sweepstakes program
• Your violation of any rights of a third party, including intellectual property or privacy rights
• Any claim that your use of the Service caused damage to a third party

The Service and its original content, features, and functionality are and will remain the exclusive property of Try It Program and its licensors. Our trademarks, trade dress, logos, and service marks may not be used in connection with any product or service without our prior written consent.

You may not reproduce, distribute, modify, create derivative works of, publicly display, republish, download, store, or transmit any material from our Service except as incidental to normal browsing use.

You agree not to use the Service to:

• Provide false, misleading, or inaccurate personal information
• Use automated scripts, bots, or other tools to submit information or interact with the Service
• Engage in fraudulent activity, including submitting fictitious or stolen personal information
• Attempt to access accounts, data, or systems not authorized for your use

Try It Program reserves the right, at its sole discretion, to modify or replace these Terms at any time. If a revision is material, we will endeavor to provide reasonable notice prior to new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you must stop using the Service. We also reserve the right to modify, suspend, or discontinue the Service at any time without notice or liability.

These Terms shall be governed by and construed in accordance with the laws of the United States and the state in which Try It Program is incorporated, without regard to conflict of law provisions.

Any dispute arising from or relating to these Terms or your use of the Service shall first be attempted to be resolved through good-faith negotiation. If informal resolution fails, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You waive any right to participate in a class-action lawsuit or class-wide arbitration.

Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent actual or threatened infringement of intellectual property rights.
